Subject: 19692/Final PUD/ Hamilton Acres Date: Mon, 27 Feb 1989 12:20:00 -0500 1992-103 Hamilton Acres PUD RESOLUTION NO. 19692 A RESOLUTION APPROVING A FINAL INSTITUTIONAL PLANNED UNIT DEVELOPMENT FOR HAMILTON ACRES. _______________________ WHEREAS, the Chattanooga City Council approved, with conditions, the Preliminary Planned Unit Development for Hamilton Acres Planned Unit Development which was then called Church of God - Addition No. 4 on July 14, 1992, by resolution No. 19519; WHEREAS, a final Institutional Planned Unit Development Plan which substantially conforms to the Preliminary Institutional Planned Unit Development Plan has been submitted; and WHEREAS, contour lines and road profiles have been submitted on separate drawings; and WHEREAS, the conditions in Resolution No. 19519 have been met or are included with conditions below; and WHEREAS, the Chattanooga Fire Department has decided not to require additional fire hydrants or water lines; and WHEREAS, the Chattanooga Board of Zoning Appeals approved variances on September 21, 1992, by Case no. 1793-92; and WHEREAS, a copy of the Final Institutional Planned Unit Development plan is attached hereto and incorporated herein. 0C NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That the Final Institutional Planned Unit Development for the Hamilton Acres Planned Unit Development be approved, subject to recording a final plan which meets the following conditions: A. Planning Commission Conditions 1. Add "September 21, 1992." to the end of notes 11-15. 2. Add the following note as note 16 on sheets 1 and 2: "There are 43 existing dwelling units. The density is 6.5 units per acre". 3. In order to conform to Board of Zoning Appeals conditions, label all Common Open Space areas as "Common Open Space and Parking Area". 4. Add the following note as note 17 on sheets 1 and 2: "No building is permitted on the Common Open Space and Parking Areas". 5. Add the following note as note 18 on sheets 1 and 2: "All Common Open Space and Parking Areas and all private roadways shown on this plat are easements for underground water and sewer connections to any existing dwellings in Hamilton Acres P.U.D." 6. Refer to notes 17 and 18 in all Common Open Space and Parking Areas. 7. Label one typical structure area as such. 8. Add the following note as note 19 on sheet 1: "The areas of lots 7, 8, 10-13, 15, 16 and 18 outside structure areas shown are easements for any existing water or sewer connections to existing structures on lots 1, 3-6 and 19-24". 9. Refer to note 19 in lots 7, 8, 10-13, 15, 16 and 18 on the plan. 10. Add the following note as note 19 on sheet 2: "The areas of lots 26-36, 38-43, 46-49, 53, 55 and 56 outside structure areas shown are easements for any existing water and sewer connections to any existing structure or structures on any of these lots." 11. Refer to note 19 in lots 26-36, 38-43, 46-49, 53, 55 and 56. 12. Add the following note as note 20 on both sheets: "All sanitary sewers in Hamilton Acres P.U.D. are private. The City of Chattanooga is not responsible for construction or maintenance of any sanitary sewers in this P.U.D." 13. In notes 8 and 9 on both sheets change "Common Open Space" to "Common Open Space and Parking Areas". 14. Add a 10' Utility Easement along the north lines of lots 52-55 except where the building on lot 43 is located. 15. Hamilton View Street is in two parts and must have two separate names. Give the part of this street at lots 6, 7, 18, 19 and 25-28 a separate name from the part at lots 29, 40, 41, 51, 52 and 56. The new name cannot duplicate any existing name in this subdivision or any existing or proposed street name in Hamilton County regardless of prefix or suffix as required by the Chattanooga Subdivision Regulations. Please contact Mr. Fred Brunker of the Planning Commission staff at 757-2383 to check any proposed road names for conflicts. 16. Add a 10' water line easement in lots 19 and 20 centered on the existing water line. Utility Conditions 1.
